Aapti’s submission to the Draft Digital Personal Data Protection Bill 2022

The revised Digital Data Protection Bill 2022 was published on the Ministry of Electronics and Information Technology website on November 22nd, 2022. This was released after its precursor Personal Data Protection Bill 2019 was withdrawn on August 4th, 2022. The government has invited inputs on the Digital Data Protection Bill 2022 (DPDPB) that aims to provide for the processing of digital personal data in a manner that recognizes both the right of individuals to protect their personal data and the need to process personal data for lawful purposes. The Bill, however, fails to adequately provide for the much-needed certainty in the regulatory framework on personal data use, and protection to the right to privacy.
